Businesses listen up!!! If you haven’t heard yet, there are new employment law updates that affect any business that employs one or more employees. The State of Minnesota has passed laws that go into effect January 1, 2024. What these new labor intense laws include is Earned Sick and Safe Time otherwise known as ESST. This provides paid leave to employees who work in Minnesota. All employees are eligible for 1 hour of ESST for every 30 hours worked up to 48 hours, which is funded by the employer. This ESST can be used for multiple reasons, including closures due to inclement weather for the employee or a member of their family, an employee or their family members mental or physical illness, treatment or preventive care. It is also inclusive for absence due to domestic abuse, sexual assault or stalking of the employee or a family member. All business owners are required to start accrual on the first day of employment and employees may use hours as they are accrued once they have worked 80 hours.  This new policy must be spelled out in Employee Handbook prior to the start of the New Year and All Paystubs need to reflect this PSST time. This is just a brief summary of what this new PSST time entails, the only employees that are NOT required for PSST is Independent Contractors, Flight Deck or Cabin Crew Employees or Carriers/Pilots, and Federal Employees. IF you are a small business owner and you have one or more employees, it is imperative that you research and learn about these new policies being implemented on January 1st. In the past, employers with less than 7 employees were exempt but not any more.  Other major changes are coming in the form of Pay History Ban, Paid Family and Medical Leave, Nursing Mothers, Lactating Employees and Pregnancy Accommodations, Pregnancy and Parenting Leave Act and Noncompete Ban. There are other general requirements for small business that need to be addressed. The Minnesota Department of Labor has information on their website. Another great resource is the Southwest Small Business Development Center. The SBDA can provide one-on-one confidential business consulting services at no cost to you. Don’t wait too long to seek understanding of these new laws because January 1st is just 67 days away!
